Monaru.lk is a service provided by Monaru Solutions (Pvt) Ltd, subject to your compliance with the Terms and Conditions outlined below. Please read these carefully before using our platform.

PART A: PLATFORM TERMS

1. General

Advertisers and users are solely responsible for ensuring that all advertising content — including text, images, graphics, videos, and other materials (“Content”) — complies with applicable Sri Lankan laws.

Monaru.lk and Monaru Solutions (Pvt) Ltd assume no liability for any unlawful or inaccurate content uploaded by users.

By submitting content to Monaru.lk, users affirm that their content does not infringe on copyright, intellectual property, or other rights of third parties. Users agree to release Monaru.lk and Monaru Solutions (Pvt) Ltd from all claims or liabilities arising from the use (or inability to use) the platform.

Advertisers acknowledge that their content may be displayed on Monaru.lk’s partner or affiliate sites under the same terms and conditions.

Advertisers grant Monaru.lk and Monaru Solutions (Pvt) Ltd a perpetual, royalty-free, non-exclusive license to use, reproduce, adapt, modify, publish, translate, and distribute submitted content across any current or future media.

All content and services on Monaru.lk, including software, trademarks, and materials, are the property of Monaru Solutions (Pvt) Ltd or its licensors. No part of this website may be copied, reproduced, reposted, or distributed without written consent.

3. Watermarks

Images uploaded to Monaru.lk may include watermarks to prevent unauthorized reuse without the advertiser’s permission.

4. Content Moderation and Image Guidelines

Monaru.lk reserves the right to edit or alter ad titles and reject or remove images that are irrelevant, misleading, or violate our content guidelines.

Monaru.lk may cooperate with law enforcement in cases where content breaches local laws. User identities, including IP addresses, may be shared with authorities when necessary.

6. Privacy Policy

By using Monaru.lk, users agree to the collection and use of personal data by Monaru Solutions (Pvt) Ltd. This may include sharing information with affiliated entities for the purpose of improving services, support, research, and marketing.

7. Cookies

Monaru.lk uses cookies to ensure full website functionality. A cookie is a small data file used to enhance the browsing experience. It does not collect personal data or allow access to files on your device.

8. User Email Addresses

A valid email address is required to post ads. Monaru.lk does not display user email addresses publicly. Other users can communicate via the internal messaging system.

9. Site Availability

Monaru.lk is provided on an “as is” basis. While we strive for high uptime, Monaru Solutions (Pvt) Ltd does not guarantee uninterrupted access to the platform.

The platform may contain links to third-party websites. Monaru.lk is not responsible for the content or security of these sites. Users follow external links at their own risk.

11. Paid Services and Promotions

Some services on Monaru.lk, such as ad promotions or memberships, require payment. All payments are to be made in advance and are non-refundable unless explicitly stated.

12. Business Accounts and Shops

Users who purchase membership packages may have access to a dedicated Shop page managed by Monaru.lk. We reserve the right to remove or reject content that violates our policies.

13. Disclaimer

Monaru.lk and Monaru Solutions (Pvt) Ltd are not liable for:

  • Errors, technical issues, or outdated content
  • Issues caused by third-party content or websites
  • Platform downtime or limited availability
  • Damages resulting from the use of the platform or user-generated content
  • Any equipment or software issues arising from use of Monaru.lk

14. Indemnification

Users agree to indemnify Monaru.lk and Monaru Solutions (Pvt) Ltd, including its directors, employees, and agents, from any losses or claims arising from the misuse of the platform or violations of these Terms and Conditions.

15. Modifications

Monaru.lk may update these Terms and Conditions at any time. Continued use of the platform implies acceptance of the updated terms. It is the user’s responsibility to review these changes.

16. Governing Law

Monaru.lk is operated in accordance with the laws and regulations of Sri Lanka.


PART B: AFFILIATE & REFERRAL PROGRAM TERMS

17.1. The Monaru Affiliate Program (“Program”) is a referral rewards program operated by Monaru Solutions (Pvt) Ltd. It allows registered users to earn commissions when people they refer make qualifying purchases on the platform.

17.2. This Program is NOT:

  • An investment scheme or opportunity
  • A pyramid scheme or multi-level marketing scheme as defined under Section 83C of the Banking Act No. 30 of 1988
  • A Ponzi scheme or money circulation scheme
  • A deposit-taking or fund-collecting scheme
  • A guaranteed income opportunity

17.3. No fees are required to join. There is no registration fee, membership fee, entry fee, or mandatory purchase required to participate in this Program.

17.4. No guaranteed returns. Participation does not guarantee any income. Earnings depend entirely on actual purchases made by referred users on the Monaru.lk platform.

17.5. Compliance. This Program is designed to comply with:

  • Section 83C of the Banking Act No. 30 of 1988 (Prohibition of Pyramid Schemes)
  • Consumer Affairs Authority Act No. 9 of 2003
  • All applicable Central Bank of Sri Lanka (CBSL) regulations
  • Prevention of Money Laundering Act
  • Financial Transactions Reporting Act

18. Eligibility & Registration

18.1. Participants must be at least 18 years of age.

18.2. Participants must be Sri Lankan citizens or permanent residents with a valid government-issued identification document (NIC, Driving License, or Passport).

18.3. One account per person. Creating multiple accounts to exploit the referral system is strictly prohibited and will result in immediate termination.

18.4. By registering on Monaru.lk and/or using a referral code, you acknowledge that you have read, understood, and agree to these Terms.

19. BDM Program & Affiliate Ranks

19.1. Participation in the Business Development Manager (BDM) program is voluntary. Monaru.lk reserves the right to approve or reject any BDM application without providing a reason.

19.2. BDMs and Affiliates are independent contractors, not employees of Monaru Solutions (Pvt) Ltd. No employment relationship, partnership, or agency is created by participation in this Program.

19.3. Commission Structure: Commissions are paid based on the rank achieved (from Starter to Platinum). Monaru.lk reserves the right to modify commission percentages with reasonable notice.

19.4. Rank Promotion: Ranks are determined by the number of qualifying referrals and total approved earnings. Promotion is automatic when criteria are met. Demotion may occur if criteria are no longer met due to commission reversals.

19.5. Prohibited Tactics: BDMs and Affiliates may not use spam, misleading claims, or impersonate Monaru.lk staff. Violation results in immediate account termination and forfeiture of unpaid commissions.

20. Commission Structure & Levels

20.1. Maximum 2 Referral Levels:

  • Level 1 (Direct Referral): Commission earned on qualifying purchases made by users you directly referred to the platform.
  • Level 2 (Indirect Referral): Commission earned on qualifying purchases made by users referred by your direct referrals.

20.2. No further levels exist. The referral chain is strictly limited to 2 levels. There is no Level 3, 4, 5, or beyond. This hard limit is enforced by the system and cannot be changed.

20.3. Commission is earned ONLY from actual sales. No commission, bonus, or reward is paid simply for recruiting new members. A referred user must make a qualifying purchase for any commission to be generated.

20.4. Commission Rates:

  • Rates are set by Monaru administration and displayed in the Affiliate Dashboard.
  • Rates may be percentage-based or fixed amounts per qualifying transaction.
  • Rates may vary by rank.
  • Monaru reserves the right to adjust rates with notice.

20.5. Commission Base:

  • Commission is calculated on the actual order total AFTER all discounts, coupons, and promotional credits are applied.
  • Promotional store credits and welcome credits are excluded from the commission calculation base.

20.6. Qualifying Purchase:

  • A purchase qualifies for commission only when the WooCommerce order reaches “completed” status.
  • Cancelled, refunded, or disputed orders do not qualify.
  • If an order is refunded after commission is paid, the commission will be reversed.

21. Signup Bonus

21.1. A one-time signup bonus may be awarded to the referrer when a new user registers using their referral code.

21.2. The signup bonus is a promotional reward to encourage platform growth — it is NOT a recruitment fee or payment for recruiting.

21.3. Signup bonuses require manual approval by Monaru staff and may be rejected if:

  • The referred user is suspected to be a fake or duplicate account
  • The referral appears to be self-referral (same person, same device, same IP)
  • The referred user does not complete identity verification
  • Fraudulent activity is detected

21.4. The signup bonus amount is set by administration and may change without notice.

22. KYC & Payout Eligibility

22.1. To prevent fraud and comply with Anti-Money Laundering (AML) standards in Sri Lanka, all Affiliates must complete a “Know Your Customer” (KYC) verification before requesting payouts.

22.2. Verification requires a clear photo of a government-issued ID (NIC, Driving License, or Passport).

22.3. Payouts will only be processed if the name on the ID matches the bank account holder’s name exactly.

22.4. Monaru reserves the right to request additional verification at any time.

22.5. Providing false or fraudulent identification documents is a criminal offence under Sri Lankan law and will be reported to authorities.

23. Payout Thresholds & Schedule

23.1. The minimum payout threshold is LKR 1,000 (subject to change).

23.2. A processing fee (currently LKR 200) is deducted from each payout request.

23.3. Welcome bonuses and signup bonuses are “locked” until a minimum total sales revenue threshold is achieved by the affiliate’s referral network.

23.4. Payouts are processed upon request and subject to manual approval by Monaru staff.

23.5. Only one active payout request is permitted at a time.

23.6. Monaru reserves the right to delay or reject payouts if:

  • Fraud or manipulation is suspected
  • KYC verification is incomplete or invalid
  • The affiliate has violated any term of this agreement
  • Unusual activity patterns are detected

24. Wallets & Store Credits

24.1. Main Wallet: Contains approved commission earnings. Funds in the Main Wallet are eligible for bank withdrawal (subject to minimum threshold and fees).

24.2. Promo Wallet: Contains promotional store credits (welcome credits, admin-issued credits, or transferred funds). Promo Wallet funds are:

  • Non-withdrawable — cannot be converted to cash
  • Non-transferable — cannot be sent to other users
  • Usable only to generate discount coupons for purchases on Monaru.lk
  • Subject to expiry dates

24.3. Welcome Credits: Verified users may receive promotional store credits upon identity verification. These credits:

  • Have a configurable expiry period (default 30 days)
  • Can only be used to generate discount coupons
  • Are automatically revoked if verification is reversed
  • Do not generate commission for the credit holder’s referrer when used

24.4. Wallet Transfer: Affiliates may transfer funds from Main Wallet to Promo Wallet (one-way, irreversible). This is intended for affiliates who wish to use their earnings as store discounts.

25. Prohibited Activities

The following activities are strictly prohibited and will result in immediate account termination, forfeiture of all wallet balances, and potential legal action:

25.1. Self-Referral: Creating multiple accounts to refer yourself or using another person’s identity to create accounts linked to your referral code.

25.2. Fake Referrals: Using fake identities, bots, purchased traffic, or any automated means to generate referrals.

25.3. Order Manipulation: Placing fake orders, colluding with referred users to place and cancel orders, or any scheme to artificially generate commissions.

25.4. Misrepresentation: Claiming this Program is an “investment opportunity,” “guaranteed income,” “passive income scheme,” or any similar characterization that misrepresents the nature of the Program.

25.5. Promoting as Pyramid/Investment: Marketing or advertising this Program as a way to “earn money by recruiting” without clearly stating that earnings are based on actual sales only.

25.6. Spam: Mass unsolicited messaging, bulk SMS, or any form of spam to promote referral codes.

25.7. Impersonation: Representing yourself as a Monaru employee, official partner, or authorized representative.

25.8. Money Laundering: Using the Program to launder money or facilitate any illegal financial activity.

25.9. Document Fraud: Submitting forged, altered, or stolen identification documents for verification.

25.10. Collusion: Coordinating with other affiliates to artificially inflate commissions through circular purchasing or other schemes.

26. Enforcement & Consequences

26.1. Violation of any term may result in one or more of the following actions, at Monaru’s sole discretion:

  • Written warning
  • Commission reversal (clawback)
  • Temporary account suspension
  • Permanent account termination
  • Forfeiture of all Main Wallet and Promo Wallet balances
  • Cancellation of pending payout requests
  • Reporting to law enforcement authorities
  • Civil legal action for damages

26.2. Monaru reserves the right to terminate any Affiliate account at any time with or without cause, with 7 days notice for accounts in good standing.

26.3. Upon termination for cause (fraud/violation), all pending payouts and wallet balances are immediately forfeited.

26.4. Upon voluntary withdrawal or termination without cause, the affiliate may request a final payout of their Main Wallet balance (subject to minimum threshold and verification).

27. Tax Responsibility

27.1. Affiliates are solely responsible for declaring and paying any applicable taxes on their earnings from this Program.

27.2. Monaru Solutions (Pvt) Ltd does not withhold taxes on behalf of affiliates.

27.3. Monaru may provide earnings statements upon request for tax filing purposes.

28. Limitation of Liability

28.1. Monaru Solutions (Pvt) Ltd makes no guarantees about potential earnings from this Program.

28.2. Monaru is not liable for any losses, damages, or expenses incurred by Affiliates in connection with their participation in this Program.

28.3. The Program may be modified, suspended, or terminated at any time with reasonable notice.

28.4. Monaru’s total liability to any Affiliate shall not exceed the total commissions actually paid to that Affiliate in the preceding 3 months.

29. Data Protection & Privacy

29.1. Affiliate data (including referral relationships, earnings, and verification documents) is stored securely and processed in accordance with our Privacy Policy.

29.2. Monaru may use aggregated, anonymized affiliate data for compliance reporting, business analytics, and regulatory purposes.

29.3. Verification documents are stored securely and are accessible only to authorized Monaru staff.


PART C: GENERAL PROVISIONS

30. Entire Agreement

These Terms and Conditions (Parts A, B, and C) constitute the entire agreement between the user/affiliate and Monaru Solutions (Pvt) Ltd regarding the use of Monaru.lk and participation in the Affiliate Program.

31. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

32. Modifications

Monaru.lk may update these Terms and Conditions at any time. Material changes to the Affiliate Program terms will be communicated via email and/or dashboard notification at least 14 days before taking effect. Continued use of the platform after changes take effect implies acceptance of the updated terms.

33. Dispute Resolution

33.1. Any disputes arising from these Terms shall first be attempted to be resolved through good-faith negotiation.

33.2. If negotiation fails, disputes shall be resolved through mediation or, if necessary, in the courts of Colombo, Sri Lanka.

34. Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of the Democratic Socialist Republic of Sri Lanka, including but not limited to:

  • Banking Act No. 30 of 1988 (as amended)
  • Consumer Affairs Authority Act No. 9 of 2003
  • Electronic Transactions Act No. 19 of 2006
  • Computer Crimes Act No. 24 of 2007
  • Prevention of Money Laundering Act No. 5 of 2006
